Attn Owner of No. 1 Chinese:The New York State Labor Law generally considers tips to be wages. If the employer is paying employees below minimum wage while they are either not receiving tips and/or the employer continues to allow customers to tip without notifying them that the tips will not go to the workers, the affected employees can file claims with the New York State Department of Labor for said violation. We would need the worker(s) to mail us a signed written statement with the relevant information (e.g., your occupation, number of employees, average amount of tips per day, when the employer started to retain the tips, name/address of the employers company, your name/address/phone number, etc.).Our office address is: Division of Labor Standards Building 12.
